10DLC Compliance: Creating a Compliant Digital Opt-in Form

Overview
When registering your brand and campaigns for 10DLC (10-Digit Long Code) on the Wire2Air TXTImpact platform, mobile carriers require proof of how you collect consent (opt-ins) from your contacts. If you use a web form, it must meet specific "Clear and Conspicuous" standards to ensure your campaign is approved.
This guide provides a visual mock-up and a checklist of the required elements for a compliant SMS opt-in form.
Mock-up: Compliant Web Form
Below is a visual representation of what your web form should look like. You can use this as a reference for your web developers.

Anatomy of a Compliant Form
To ensure your campaign is approved by carriers (AT&T, T-Mobile, Verizon), your form must include these 5 Key Elements:
1. The Checkbox (Must be Optional)
- Requirement: The checkbox must be specific to SMS. It cannot be combined with email consent or general "Terms of Service" agreements.
- Unchecked by Default: The box must not be pre-checked. The user must manually click it to opt in.
- Not Mandatory: A user should be able to submit the form without checking the SMS box (unless the sole purpose of the form is to subscribe to SMS).
2. Clear Brand Identification
- Your legal business name or registered DBAs (e.g., "Wire2Air" or "TXTImpact") must be visible in the disclaimer text.
3. The Compliance Disclaimer Text
You must include the following statutory language right next to the checkbox. Copy and paste this text, replacing the bracketed information with your own:
"By providing your phone number, you agree to receive SMS [Insert Use Case, e.g., marketing offers, alerts] from [Insert Company Name]. Message frequency may vary. Standard Message and Data Rates may apply. Reply STOP to opt out. Reply HELP for help."
4. Privacy Policy Link & Statement
- You must link to your Privacy Policy.
- Crucial Addition: Your privacy policy or the disclaimer text must explicitly state that you do not share mobile data for marketing purposes.
- Example: "We will not share mobile information with third parties for promotional or marketing purposes."
5. Special Use Cases (Political & Non-Profit)
- Non-Profits: If you are a 501(c)(3) soliciting donations, you must add: "Donations may be solicited."
- Marketing: If the messages are promotional, ensure the text says: "You are opting into marketing texts."
Common Reasons for Rejection
- ❌ Buried Consent: The SMS opt-in is hidden inside a "Terms and Conditions" link rather than being visible on the page.
- ❌ Forced Opt-in: The SMS checkbox is a "required" field to submit a general contact form.
- ❌ Missing Disclaimers: Failing to mention "Message and data rates may apply" or "Reply STOP to opt out."
- ❌ Pre-checked Boxes: The checkbox was already ticked when the page loaded.
